Definitions

‘The Site’ means www.fantasticforfamilies.com

‘The Campaign’ means the Family Arts Campaign, which is a project of the Albany, led by the consortium of organisations detailed under ‘Ownership’.

The Terms of Use are the terms which users of the Site accept by using the service provided by the Site and detail the responsibilities of the providers, the Albany.

‘We/Us/ Our’ refers to the Campaign, and therefore to the Albany, as the accountable organisation for the Campaign.

‘You/Your’ refers to users of The Site.

‘User Generated content’ refers to any form of content created by users of the Site that is publicly available.


Ownership
The Family Arts Campaign is an initiative led by a consortium of organisations which include: the Albany, The Association of British Orchestras, UK Theatre, The Society of London Theatre, The Independent Theatre Council, The Contemporary Visual Arts Network, One Dance UK, the Audience Agency, The Arts Marketing Association and Voluntary Arts.

The Campaign is supported using public funding through Arts Council England. 

 
The Fantastic for Families Site (also referred to below as the Site) is owned by The Albany, a charity (no 1112521), registered company 4333098 (England) with offices at The Albany, Douglas Way, Deptford, London SE8 4AG. If you would like to contact us or register a complaint about anything contained on the Site, please contact us using the following details.

Fantastic for Families has been designed as a resource to connect arts organisations to as many families as possible looking for quality arts events to take part in together.

  • It is free to use for both events organisers listing their events, and members of the public accessing these events
  • The Fantastic for Families site is accessible to everyone
  • Personal data is never passed to third parties and is only used by the Albany for activities related to Fantastic for Families statistical analysis and reporting, as required by our funders, with all personal data of users remaining anonymous
  • You have a right to access the personal information we hold at the Albany about you at any time. If you wish to do this, please put your request in writing to the Head of Campaign and direct your request via the email address above


Data Protection and Privacy
We will only use any personal information that we may collect about you in accordance with our Privacy Policy. Please also read our Cookies Usage Policy to see how we use cookies on this Site. By accepting our Terms of Use you also accept and consent to our Privacy Policy and Cookies Usage Policy.

Cookies
We want to make our service easy, useful and reliable for its users. Where services are delivered on the internet, this sometimes involves placing small amounts of information on your device, for example, computer or mobile phone. These include small files known as cookies. They cannot be used to identify you personally.
These pieces of information are used to improve services for you through, for example: 

  • enabling a service to recognise your device so you don't have to give the same information several times during one task

The Site uses two first party cookies - these are only used for those pages which require membership log in.

All Intellectual Property Rights in and to the Site and all content and materials contained therein are owned by and shall remain owned by the Albany or our licensors. You may view, download and print any materials and information made available to you through the Site subject to the following terms:

(b) the material and information shall not be reproduced or included in any other work or publication in any medium;
(c) the material and information may not be modified or altered in any way;
(d) the material and information may not be distributed or sold to any third party;
(e) you may not remove any copyright or other proprietary notices contained in the material or the information


For the avoidance of doubt, these Terms of Use are not intended to prevent you recording in manual form any individual item of information, or disclosing any individual item of information, free of charge, to friends or relations for non-commercial purposes provided that you take all reasonable steps to ensure that any person to whom you may disclose that information complies with these.

 
This Site contains links to websites and microsites operated by third parties that are not under our control and are provided to you for your convenience only. We make no warranties or representations whatsoever about any other website which you may access through this Site or any services that they may provide. Without limiting the foregoing, these sites are in no way approved, vetted, checked or endorsed by us and you agree that we shall not be responsible or in any way liable for the content, accuracy, compliance with relevant laws or accessibility of any information, data, advice or statements or for the quality of any products or services available on such sites. Liability
Nothing in these Terms of Use shall exclude or limit our liability for:


(a) death or personal injury caused by our negligence; or
(b) any loss suffered by you as a result of your reliance on any fraudulent misrepresentation made by us to you;


Subject to (a) and 9b) above we shall not be liable for:

(a) any direct loss, claim or damage;

(b) any indirect loss, claim or damage, or any punitive, special, incidental or consequential damages of any kind; or

(c) any loss of profit or loss of savings or loss or corruption of data (in each case whether direct or indirect), in each case whether based in contract, tort (including negligence), strict liability, or otherwise, which arises out of or is in any way connected with (i) any use of this Site or its contents including any User Generated Content on the Site; (ii) any failure or delay in the use of any component of the Site or any service including, without limitation, any unavailability of the Site or the services irrespective of the duration of any period of unavailability; or (iii) any use of or reliance upon any information, material, software, products, services and related graphics obtained through the Site, in all cases even if we have been forewarned of the possibility of such loss or damage.


Without limiting the effect of clauses above, due to the inherent risks of using the internet, we cannot be liable for any damage to, or viruses that may infect your computer equipment or any other property when using or browsing the Site. The downloading or other acquisition of any materials or information through the Site is done at your own discretion and risk and with your agreement that you will be solely responsible for any damage to your computer system or loss of data that results from the downloading or acquisition of any such materials.

Indemnity
You agree to indemnify and hold the Albany, its affiliates, and each of their trustees, directors, officers, agents, contractors, partners and employees involved with the Fantastic For Families site, harmless from and against any loss, liability, claim, demand, damages, costs and expenses, including legal fees incurred, arising out of or in connection with any User Generated Content you post or share on or through the Site, your use of the Site or the services provided through the Site, your conduct in connection with the Site or services provided or with other users of the Site, or any violation of these Terms of Use or of any law or the rights of any third party.
